Who we are
This website is operated by CertainData Ltd, a company registered in England & Wales under company number 17354647 (official name: CERTAIN DATA LTD), whose registered office is at Venture House, 2 Arlington Square, Downshire Way, Bracknell, Berkshire, RG12 1WA. In these Terms, "CertainData", "we", "us" and "our" refer to CertainData Ltd.
These Terms govern your use of certaindata.ai (the "Site"). By using the Site you agree to them. If you do not agree, please do not use the Site.
1. What the Site is for
The Site describes the data products and services CertainData makes, how they work, where their data comes from and how to use them. The Site itself does not sell anything, and you do not need an account to use it.
2. Buying our products
Our products are sold through PowaHub, a platform operated by CertainData Ltd, and can be bought by AI agents using PowaAgent or any compatible client. When you buy or use one of our products, the PowaHub Terms of Service and Data Licensing + Usage Terms apply to that purchase, together with any product-specific terms shown on the product's page.
3. Product information and prices
We take care to keep product descriptions, sample responses and prices on the Site accurate. Prices on the Site are shown for information. The price that applies to a call is the price presented in the payment request at the time of that call.
We may add, change or withdraw products, and change their prices, at any time. Changes do not affect calls already completed.
4. Data products
Our data products are provided "as is" and "as available". Data from any source can be incomplete, delayed or wrong, and a product's data is only as current as its stated refresh schedule. Nothing a data product returns is a regulatory, compliance, credit or legal decision, and using our products does not discharge any obligation you have under the law that applies to you.
5. Identity verification
Our identity verification service returns evidence about an identity document and the capture session, together with an outcome and the reasons for it. You decide whether and how to rely on that evidence. It is not a decision about a person, and it is not a sanctions, anti-money-laundering or credit check.
6. Third-party data and licences
Some of our products include data that we licence from third parties. That data remains subject to its licence, and some licences require attribution or place conditions on how the data is reused. The licence for each source is shown on its product page and on our Licences and attribution page. You must keep any required attribution and comply with those conditions.
7. Using the Site
You may view, download and print pages of the Site for your own reference. You must not:
- use the Site in any way that is unlawful or fraudulent;
- attempt to gain unauthorised access to the Site, the systems that host it or any connected network;
- interfere with the Site's operation, including by introducing malicious code or placing an unreasonable load on it; or
- copy substantial parts of the Site's content to publish elsewhere without our permission.
The Site's content, design and the CertainData name and logo belong to CertainData Ltd or its licensors.
The Site may link to websites run by others, including PowaHub and PowaAgent websites. Those websites have their own terms and privacy notices.
8. Our liability
Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Subject to that, the Site is provided free of charge for information, and we are not liable for any loss arising from your use of, or reliance on, the Site's content. Our liability for products you buy is set out in the terms that govern that purchase (see section 2).
9. Changes to these Terms
We may update these Terms from time to time. The current version is always on this page, with the date it was last updated.
10. Governing law
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over disputes arising out of or relating to them, unless applicable law requires otherwise.
